Chapter 7 Bankruptcy
This option creates a fresh start for individuals who need to eliminate debt they can no longer afford to pay. Chapter 7 is designed to provide you with immediate relief from creditor calls, wage garnishments except for child support, and stop lawsuits against you. This form of bankruptcy allows you to move quickly through the bankruptcy process and obtain your discharge in about 90 days from when your case is filed. In a Chapter 7 bankruptcy case, you surrender non-exempt assets to the trustee for liquidation, and most debts that you don’t reaffirm will be discharged, relieving you of responsibility even if they can’t be paid from the proceeds.
Chapter 13 Bankruptcy
Filing Chapter 13 enables individuals with regular income to create a court approved payment plan for your creditors based on monthly payments you can afford. This allows you to retain your house, cars, and other assets, by allowing you to “pay for what you keep” over time. Chapter 13 also allows you to catch up on your past due mortgage or car payments over time, all while stopping lawsuits, wage garnishments, foreclosures and repossessions. Upon completion of your payment plan, you’ll receive a discharge for all debts that weren’t repaid, and while certain debts like taxes, child support, or alimony can’t be discharged, your creditors can no longer bother you for the debts that were discharged.
